‘All the ETA crimes are against humanity, and therefore are never prescribed’


Lawyer, Miguel Ángel Rodríguez Arias, is leading the judicial action against the terrorists in the National Court, which is investigating ETA on the charge of genocide.

The lawyer continued ‘what ETA has done is a policy organised by persecution, of daily harassment, assassinations, for forced exit from homes and disappearances’. He considers the 1971 Penal Code is sufficient for the charges of crimes against humanity and genocide.

Judge Javier Gómez Bermúdez (who presided the Madrid train bombings case) has asked for reports from the Ertzainzta (Basque Police), National Police, Guardia Civil and the Collective of Terrorism Victims (Covite), which will allow him to next month present a report to prosecutor in the International Penal Court in the Hague, charging ETA with crimes against humanity and genocide, supporting the work which has been done since 2006 by judge Rodríguez Arias.

At first Judge Javier Gómez Bermúdez said it was not his competence to investigate these crimes, but the Section Four of the Penal Court ruled the National Court is competent to judge crimes against humanity committed in Spain adding this competence is important because this is the first time the question has arisen in Spain. For example, in the case of the crimes during the Franco years, the National Court did not recognise its competence, but now it must.

The initial report has 1,200 pages and has been a well-thought out document after many years of work. The judge has said his idea is to place the report and keep as quiet as possible to let the International Court do its job. We will continue to work discretely to advance the case forward as much as possible.

Over the life of Euskadi Ta Askatasuna (Basque Country and Liberty in Euskadi) there have been 2,472 terrorist acts and 114 fatal attacks which still have not been solved.
